The central government on Thursday released guidelines for social media, OTT platforms and digital news. Law Minister Ravi Shankar Prasad said that if any wrong content is put on social media, it will have to be removed within 24 hours. Information and Broadcasting Minister Prakash Javadekar said about OTT and digital news portals that they should have a system to control themselves.
These rules are definitely the right steps in the right direction, but we will have to wait a bit for what is actually said. It has to be studied, so that we can understand what the effect will be. The initiative is good, but it still seems that in 2021 these rules reflect the 2011 mentality. The 2011 rules said that the content should be removed in 36 hours. The same guideline comes in 2021, while the ground reality has changed completely. The ground reality is that today the 36-hour timeline does not matter. Suppose someone is defaming you, then he will continue to defame you for 36 hours. Will keep harming your reputations. After that, even if that content is removed, it has no justification.

Government strict on arbitrariness of service provider: Somewhere, the service providers were also very arbitrary, challenging the Government of India that we do not follow the law, what will you do. Now the government has taken all the service providers and OTT platforms under its control by flouting a single sweep. These have been covered in legal sections.

What will change for users?

If you are thinking that a magic wand will come in hand, it is not. Yes, it is certain that their suffering will be lessened, if the service providers obey the laws. One thing is that if someone publishes a nude or pornographic picture of someone, then it will have to be removed in 24 hours. But, during this time, where it has been used, you cannot even guess it. It should have been a period of 3 or 4 hours, but you reduced it to 24 hours. I think this law is still very soft for service providers. The search and expectation of consumers is still not fulfilled.

There will be such a change in the life of the user that the service providers who used to roam Belgaum earlier, will not be so much Belgaum. I think the challenge of these laws will reach the courts in the coming few months. Because if these laws are implemented then many models of service providers will go awry. So, I think these laws will be challenged.

Self regulation is not easy:

Government which has brought rules and regulations. Parliament has not passed it, so the word ethics is right now. There has been talk of self regulation. But, this is not going to happen in India so soon. People will not believe it until they hear the sound of the law. So if you say that you can self-regulate, then maybe you can do it too, but there is not much success. Self regulation has not been successful in many sectors.

How clean the social media mess will be:

If you think that complete change will happen, then no such thing will happen. The waiting clocks will reduce somewhat, but the wait is as long. Whether you will get justice or not, it will also depend on the person.

Impact on digital news platform:

Somewhere these rules and regulations are going beyond the primary legion and this is their biggest weakness. The rule is that the laws and regulations passed by Parliament should not be beyond that. Primary Legislation refers to section 2 (1) (w) of the IT ACT. Now they are talking about many types. Many types of categories are being introduced. These are going beyond the IT Act.

Final verdict:

Speaking of essence, we can say that finally the government has listened to the people of India. The government has taken concrete steps, although these are not as strict as they should have been. But, the government has given a clear indication to foreign companies that if you want to live in India, the cream is to be eaten here, then you cannot proceed without following the law.
